1. Acceptance of Terms
By accessing or using Mindful Momentum ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and our Cookie Policy. Together, these documents form the complete agreement between you and Mindful Momentum. If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. When we make material changes, we will notify you via email or a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
2. Eligibility
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
We do not knowingly collect or solicit information from anyone under 18. If we discover that a user is under 18, we will promptly terminate their account and delete all associated data. If you believe someone under 18 is using the Service, please contact us at legal@mindfulmomentum.com.
3. Account Registration & Security
To use the Service, you must create an account with a valid email address and password. You are responsible for:
- Providing accurate and truthful information during registration
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
We offer two-factor authentication (2FA) to help secure your account and encourage all users to enable it. We reserve the right to disable accounts that violate these Terms or that have been inactive for an extended period.
4. Description of Service
Mindful Momentum is a mindfulness and journaling platform that provides:
- Daily reflection prompts organized by thematic modes
- Free-text journaling tied to curated prompts
- Weekly reflection summaries
- Custom ritual prompts (Pro feature)
- Carry-forward reflections for ongoing themes
- Email reminders and notifications
The free tier of the Service is supported by contextual advertising. Contextual ads are selected based on the general content of the page you are viewing (e.g., a mindfulness-related page may display wellness-related ads). Contextual ads are not based on your personal data, browsing history, or journal content. Pro subscribers receive an ad-free experience.
The Service is provided "as is." We do not guarantee uninterrupted access and may modify, suspend, or discontinue features at any time with reasonable notice.
5. Data Usage for Product Improvement
By using the Service, you agree that we may use your data, in anonymized and aggregated form, for the following purposes:
- Usage pattern detection and analysis to improve the Service
- Understanding how features are used to inform product development
- Measuring the effectiveness of prompts and reflection modes
- Generating aggregate statistics about Service usage
We will never sell, share, license, or otherwise provide your personal journal entries or identifiable personal data to third parties for marketing or advertising purposes.
Your journal content is never used for advertising. Journal entries, reflections, and personal content are never accessed, processed, or referenced for ad targeting, ad selection, or ad delivery. The contextual advertising on our free tier operates independently of your personal content — ads are selected based on the page category, not what you have written.
No AI or automated content analysis. We do not use artificial intelligence, machine learning, or automated content analysis systems to analyze, interpret, summarize, score, or generate insights from your private journal entries or reflections. Your words are yours alone.
No behavioral profiling. We do not build user profiles based on your journal content, emotional themes, or reflection patterns. Anonymized usage analytics (such as which features are popular) are never derived from the substance of what you write.
Staff access limitations. Our team does not access or read your private journal entries except where strictly required for technical troubleshooting with your explicit consent, or where required by law, including valid legal process such as subpoenas or court orders.
Our business model does not depend on analyzing or monetizing your personal reflections. We earn revenue through optional paid subscriptions and contextual advertising that is independent of your content.
6. Subscriptions & Payments
The Service offers both free and paid subscription tiers. For paid subscriptions:
- Payments are processed securely through Stripe. We do not store your credit card information on our servers.
- Subscriptions automatically renew at the end of each billing period unless cancelled
- You may cancel your subscription at any time through your account settings
- Refunds for cancelled subscriptions are provided on a prorated basis at our discretion, subject to applicable consumer protection laws
- We reserve the right to change pricing with 30 days' notice
We reserve the right to suspend or terminate accounts associated with fraudulent payment activity, including abusive chargebacks or payment disputes made in bad faith.
7. Your Content & Intellectual Property
You own your content. All journal entries, reflections, ritual prompts, and other content you create through the Service remain your intellectual property.
By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service. We claim no ownership over your content and will not use your identifiable journal entries for marketing, advertising, or any purpose unrelated to providing the Service.
We have no obligation to monitor user content and do not endorse or assume responsibility for content created by users. We reserve the right to remove content that violates these Terms. To the extent applicable, we rely on the safe harbor protections of the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, please contact our designated agent at legal@mindfulmomentum.com with a description of the copyrighted work, the location of the infringing material, and your contact information.
8. Data Portability & Export
You have the right to export your data from the Service. You may request a complete copy of your journal entries, reflections, and account data in a machine-readable format by contacting us at privacy@mindfulmomentum.com. We will fulfill export requests within 30 days.
While we take reasonable measures to preserve your data, we do not guarantee permanent or uninterrupted availability of stored content. Users are encouraged to periodically export their data.
9. Cookies & Tracking
The Service uses essential cookies for session management, security, and authentication. Our contextual advertising partner may use limited cookies solely for ad frequency capping (limiting how often you see the same ad) and aggregated reporting — not for tracking, profiling, or personalizing ads based on your behavior or personal data. No advertising cookies access your journal content or personal data.
Free-tier users may manage advertising cookie preferences through the cookie consent banner provided on first visit. We do not use cross-site tracking technologies or third-party tracking pixels for behavioral advertising. For full details on the cookies we use and how to manage them, see our Cookie Policy.
10. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service's infrastructure
- Use automated systems (bots, scrapers) to access the Service without permission
- Impersonate another person or misrepresent your identity
- Upload malicious content or attempt to exploit vulnerabilities
11. Indemnification
You agree to indemnify, defend, and hold harmless Mindful Momentum and its founders, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
12. Termination & Account Deletion
You may delete your account at any time through your account settings. Upon requesting deletion:
- Your account will be deactivated immediately and you will be logged out
- If you have an active subscription, it will remain active until the end of your current billing period, after which it will not renew
- All your personal data — including journal entries, reflections, custom prompts, and account information — will be permanently deleted within 30 days of your request
- This action is irreversible once the 30-day period has elapsed
Data may persist in encrypted backup systems for up to an additional 60 days after the 30-day deletion period, after which it will be permanently purged from all systems. We recommend exporting your data before requesting deletion (see Section 8), as it will not be recoverable after the purge.
We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation. We may deny data export access in cases involving fraud, unlawful activity, or abuse of the Service.
Continuity of commitments. In the event of a merger, acquisition, or sale of assets, your data will remain subject to the commitments made in these Terms and our Privacy Policy. We will notify you before your data is transferred to a new entity or becomes subject to a different privacy policy.
13. Privacy & Regulatory Compliance
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. We are committed to compliance with applicable data protection regulations, including:
- GDPR (General Data Protection Regulation) for users in the European Economic Area and United Kingdom
- CCPA/CPRA (California Consumer Privacy Act / California Privacy Rights Act) for California residents
- Other applicable state and international data protection laws

14. Data Breach Notification
In the event of a data breach that compromises your personal information, we will:
- Notify affected users without undue delay, as required by applicable law
- Provide a description of the nature of the breach and the data involved
- Describe the measures we are taking to address the breach and mitigate its effects
- Notify relevant supervisory authorities as required by applicable law (including GDPR Article 33 and state breach notification laws)
15. Disclaimers
The Service is a journaling and mindfulness tool, not a mental health service. It is not a substitute for professional medical advice, diagnosis, or treatment. Use of the Service does not create a therapist-client, doctor-patient, or any other professional healthcare relationship. If you are experiencing a mental health crisis, please contact a qualified healthcare professional or emergency services immediately.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Mindful Momentum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or emotional distress, arising from your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
17. Force Majeure
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet or infrastructure outages, acts of government, pandemics, or third-party service provider failures.
18. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in the State of Michigan, except where prohibited by law. You agree that any dispute shall be resolved individually and waive the right to participate in any class, collective, or representative action. Nothing in this section prevents you from filing a complaint with a relevant regulatory authority, including data protection authorities under GDPR.
Where arbitration or class action waiver provisions are prohibited by local consumer protection law (including for users in the EEA, UK, or other applicable jurisdictions), disputes shall be resolved in accordance with applicable local regulations.
19. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.
